Back in 2009, Glenn Beck was obsessed with making White House regulatory czar Cass Sunstein the next Van Jones. Now, the mostly-unscathed legal scholar is leaving on his own terms as he returns to Harvard Law School, Politico's Mike Allen?reports.?At the end of the month, Sunstein, administrator of the powerful Office of Information and Regulatory Affairs, will head to Cambridge to become the director of the Program on Behavioral Economics and Public Policy.??For the last three and a half years, Cass Sunstein has helped drive a series of historic accomplishments on behalf of the American people," said President Obama in a statement. "From putting in place lifesaving protections for America?s families, to eliminating tens of millions of hours of paperwork burdens for our nation?s citizens and businesses, Cass has shown that it is possible to support economic growth without sacrificing health, safety, and the environment."

The irony of Beck's campaign against Sunstein was always that the celebrity legal scholar, married to academic-turned-special assistant to Obama Samantha Power, was originally a target of the left, who saw his appointment as an "olive branch from an incoming Democratic president to conservatives and libertarians." That perception existed because of his libertarian-leaning scholarship on behavioral economics. His skepticism toward regulations won him endorsements from conservative influence-peddlers like?The Wall Street Journal's?editorial board,?which called his nomination a "savvy choice" and labeled him an important "voice in the incoming administration," and libertarian/conservative bloggers Glenn Reynolds and?Ed Morrissey.?Of course, that honeymoon ended after Glenn Beck, thirsty for more blood following his successful campaign against White House Green Jobs Czar Van Jones, set his sights on Sunstein, as The Daily Beast's Katie Connolly wrote at the time:

The Fox News host is waging a war against Obama's "czars." ... Recently he urged fans, via his Twitter feed, to collect and save all the information they could find about Sunstein; yesterday he warned that the Democrats would lose the vote on the nomination, and suggested they are afraid of Beck fans. Beck's objections are gaining traction, evidenced by the emergence of a new Web site called?Stop Sunstein. Sponsored by the American Conservative Union, the site features a home page screaming, "President Barack Obama has nominated Cass Sunstein, a radical anti-gun, anti-hunting, animal rights law professor to be his 'regulatory czar,' " alongside images of fake newspapers declaring "Guns Banned," "Hunting Banned," and "FCC Pulls Plug on Limbaugh." The page blazes with out-of-context quotes that make Sunstein look quite loopy.

In the end, everyone sort of realized Sunstein's scholarship on the ethical problems of hunting didn't mean he was going to outlaw the sport by fiat. And Roger Ailes also seemed to realize Glenn Beck was getting a little too out there even for Fox News.

High-Profile Geneticists Post Findings on Popular Pre-Publication Site

Population biologists are turning more and more to arXiv, already popular among physicists, to gain wider readership and rapid reviews of results

The preprint server arXiv.org is perhaps best known as the preserve of theoretical physicists and astrophysicists. But 2008 saw an influx of submissions of unpublished manuscripts, or preprints, by condensed-matter physicists who wanted to stake claims to the fast-moving subject of iron-based superconductors called pnictides. Now the life sciences may be on the cusp of their own ?pnictide moment?, with population geneticists leading the charge.

In the past month, leading research groups have posted to arXiv high-profile papers on the genetic history of southern Africans¹ and Europeans². Other prominent population geneticists have submitted methods-based papers to the server, which is hosted by Cornell University in Ithaca, New York. The number of biology papers on the server is still small in comparison with physical-sciences preprints (see ?Biology opens up?), but Paul Ginsparg, a theoretical physicist at Cornell who founded arXiv in 1991 (ref. ³), welcomes what he hopes could be a sea change.

?It?s wonderful if biologists are belatedly joining the late twentieth century,? he quips. ?Welcome to the party; better late than never.?

Life-sciences papers have existed on arXiv almost since its inception, but biologists have typically shied away from this approach amid fears of getting scooped, or of offending journals. It was only in 2003 that the site inaugurated a section specifically for papers on quantitative biology, or ?q-bio? for short. Yet papers posted to the section in the past tended to report esoteric models and methods, often from physical scientists dabbling in biology.

Rich in mathematics and steeped in the open-data traditions of genomics, population genetics would seem the ideal candidate to dip its toes into pre-publication, which brings the advantages of speed and open discussion. ?I grew up in the physics community,? says Richard Neher, a population geneticist at the Max Planck Institute for Developmental Biology in T?bingen, Germany, ?and putting things up on arXiv is a natural thing for me to do.? Neher has co-authored more than ten?submissions to arXiv since 2004.

Despite such examples, one of the best-known life-sciences preprints on arXiv comes from microbiology, not population genetics. Posted as a rebuttal to a 2011 Science paper reporting that a strain of Halomonas bacteria from a Californian lake could incorporate arsenic into its DNA⁴, the preprint appeared on the server in January⁵ before its publication in Science this month⁶. Yet a population geneticist still played a part ? the paper?s co-author, Leonid Kruglyak, of Princeton University in New Jersey and the Howard Hughes Medical Institute, works in the field. Kruglyak says he will consider arXiv for future studies from his lab.

Another attention-grabbing submission by prominent geneticists, posted on 23?July, compares genomic variation in 22 African populations to suggest an ancient genetic link between people in southern and eastern Africa¹. One of the paper?s senior authors, geneticist David Reich of Harvard Medical School in Boston, Massachusetts, publishes routinely in Nature and the Public Library of Science journals, and co-author Carlos Bustamante, of Stanford University School of Medicine in California, is a leader in the field. Reich says that first author Joseph Pickrell, also at Harvard Medical School, suggested using arXiv. Reich and the other co-authors saw no good reason not to post the manuscript there. ?It could be an example of the younger generation coming in and finding this sort of thing natural,? says Ginsparg.

FTC votes to penalize Google $22.5 million for Safari cookies

WASHINGTON ?? U.S. regulators will require Google Inc to pay a civil penalty of $22.5 million to settle charges that it bypassed the privacy settings of customers using Apple Inc's Safari browser, two people familiar with the matter said on Tuesday.

Members of the Federal Trade Commission voted to approve a consent decree that will allow Google to settle the agency's investigation but admit no liability, said one of the sources, who was not authorized to speak on the record.

An official announcement is expected within days, the second source said.

The probe was prompted by allegations that Google used computer code known as "cookies" to trick Apple's Safari browser so Google could monitor users who had blocked such tracking.

Google has said the tracking was inadvertent and that it collected no personal information like names, addresses or credit card data.

But the tracking was done despite assurances that Safari could be set to protect users' privacy and prompted an FTC probe into whether Google violated a consent decree signed last year. Google said then it would not misrepresent its privacy policies.

Google also faces potential sanctions from other governments. It is being investigated by the European Union to determine if the company complies with Europe's stricter privacy laws.

The top search engine provider is also the subject of a wide-ranging antitrust investigation by the FTC and European regulators over accusations that it manipulated search results to favor its own products.

The FTC declined to comment on the Safari matter.

Google declined to comment on any settlement but said the investigation was prompted by a 2009 help center web page that predated a change in Apple's cookie-handling policy.

"We have now changed that page and taken steps to remove the ad cookies, which collected no personal information, from Apple's browsers," a Google spokeswoman said in a statement.

Twitter lifts suspension on user critical of NBC Olympics coverage

Facing an Olympic-sized public backlash, Twitter lifted its suspension of Guy Adams, a Los Angeles-based correspondent for London's Independent who had been highly critical of NBC's coverage of the 2012 London Olympics.

According to Adams, the micro-blogging service?which partnered with NBC for the summer games?alerted him of the reinstatement via email.

"We have just received an update from the complainant retracting their original request," Twitter wrote, according to Adams. "Therefore your account has been unsuspended."

No further was explanation given or apology offered by Twitter, Adams said.

Adams' account was suspended on Sunday, two days after he tweeted the corporate email address of NBC's Olympics president, Gary Zenkel, whom Adams called the "moronic" executive behind the network's decision to tape-delay events for its prime-time U.S. broadcast.

"I didn't publish a private email address, just a corporate one, which is widely available to anyone with access to Google and is identical to one that all of the tens of thousands of NBC Universal employees share," Adams argued. "It's no more 'private' than the address I'm emailing you from right now."

NBC released a statement on Monday confirming that it contacted Twitter.

"We filed a complaint with Twitter because a user tweeted the personal information of one of our executives," the network said. "According to Twitter, this is a violation of their privacy policy. Twitter alone levies discipline."

But according to the Telegraph, it was Twitter that informed NBC of Adams' tweet, not the other way around.

"Our social media [department] was actually alerted to it by Twitter," Christopher McCloskey, NBC Sports vice-president of communications, wrote in an email to the newspaper. "Then we filled out the form and submitted it."

The NBC-Twitter partnership was announced earlier this month before NBC's coverage of the games began.

"During the games, Twitter is using its Olympics events page to highlight insiders' views, and to encourage people to watch NBC's on-air and online coverage," the companies said in a press release.

"If criticizing NBC over how it's handled the Olympic coverage were cause for suspension," Michael Gartenberg, a tech industry analyst for Gartner, quipped, "Twitter would pretty much be empty right about now."

There's been so much criticism of NBC's Olympics tape-delay on Twitter, in fact, a hashtag?#NBCFail?began trending on Saturday, the network's first full day of coverage. And a parody account?@NBCDelayed?was launched on Sunday.

"Tune in tonight for the Olympic Opening Ceremonies in Beijing," one tweet read.

Despite the criticism, the tape-delay appears to be working. NBC's coverage of the opening ceremonies on Sunday delivered a 23.0 overnight rating?the best ever for an Olympics held outside the United States.
